Welcome to Casuarina. The terms “we”, “us” and “our” refer to Skill Launch Labs Pty Ltd (ABN 97 687 286 924), trading as Casuarina. We operate this store and website, including all related information, content, features, tools, products and services (the “Services”). Casuarina is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced in them, describe your rights and responsibilities when you use the Services. Please read them carefully.

By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy.

1. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law or any other law that cannot lawfully be excluded. Where our liability can lawfully be limited, our liability is limited, at our option, to replacing the goods, supplying equivalent goods, repairing the goods, or paying the cost of any of these.

This clause prevails over any other clause in these Terms to the extent of any inconsistency. For customers in New Zealand, the equivalent applies in respect of the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.

2. Access and account

By agreeing to these Terms, you represent that you are at least the age of majority in your State or Territory of residence, and that you consent to any minor dependents using the Services on devices you own or manage.

To use the Services you may be asked to provide information such as your email address and billing, payment and shipping details. You represent that this information is correct, current and complete, and that you have all rights necessary to provide it.

You are responsible for maintaining the security of your account credentials and for all account activity. You may not transfer, sell, assign or license your account to another person.

3. Our products

We make every effort to represent our products accurately. Colours and appearance may differ from how they appear on your screen due to your device and its settings.

Product descriptions may change at any time. We may discontinue a product or limit quantities available to any person or region. This clause does not limit your rights under clause 1.

4. Orders

When you place an order you are making an offer to purchase. We may accept or decline an order at our discretion. Your order is not accepted until we confirm acceptance and payment has been processed. Please review your order carefully before submitting, as we may be unable to accommodate cancellation requests after acceptance. If we decline, change or cancel an order, we will contact you using the details provided at the time of order.

Your purchases are subject to return or exchange in accordance with our Returns & Refunds Policy.

You represent that your purchases are for your own personal or household use and not for commercial resale.

5. Prices and billing

Prices, discounts and promotions may change without notice. The price charged is the price in effect when the order is placed, as set out in your order confirmation. All prices are in Australian dollars and include GST where applicable.

You agree to provide current, complete and accurate purchase, payment and account information, and to keep it updated.

You represent that any card details you provide are true and complete, that you are authorised to use the card, and that you will pay the amounts incurred at the posted prices.

6. Shipping and delivery

Delivery times set out in our Shipping Policy are estimates. We are not responsible for delays caused by carriers, customs processing, or events outside our reasonable control.

Subject to clause 1, and in particular your consumer guarantee right to delivery within a reasonable time, risk in the goods passes to you on delivery.

7. Intellectual property

The Services, including all trademarks, text, images, graphics, video, audio, and their design, selection and arrangement, are owned by us or our licensors and are protected under the Copyright Act 1968 (Cth), the Trade Marks Act 1995 (Cth) and other applicable laws.

These Terms permit you to use the Services for personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store or transmit any material on the Services without our prior written consent.

Casuarina names, logos, product names, designs and slogans are our trademarks. You must not use them without our prior written permission. Shopify’s name, logo and marks are trademarks of Shopify. All other marks belong to their respective owners.

8. Third-party tools and links

You may be given access to third-party tools that we neither monitor nor control. These are provided “as is” and “as available” without endorsement. Your use of them is at your own risk, and you should review the relevant third party’s terms.

The Services may link to websites operated by third parties. We are not responsible for their content or accuracy. Complaints regarding third-party products or services should be directed to that third party.

9. Relationship with Shopify

Casuarina is powered by Shopify, which enables us to provide the Services to you. Any sales and purchases you make in our store are made directly with Skill Launch Labs Pty Ltd. Shopify is not responsible for any aspect of any sale between you and us, including any injury, damage or loss resulting from purchased products. Nothing in this clause limits your rights under clause 1.

10. Privacy

Personal information we collect through the Services is subject to our Privacy Policy. Because the Services are hosted by Shopify, Shopify also collects and processes personal information about your use of the Services.

11. Feedback

If you submit any ideas, suggestions, feedback, reviews or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute and display it for any purpose, including commercial use.

You represent that you own or have all necessary rights to your Feedback, that you have disclosed any compensation or incentive received in connection with it, and that it complies with these Terms. We are not obliged to keep Feedback confidential, to pay for it, or to respond to it.

Your Feedback must not infringe any third-party right or contain unlawful, abusive, defamatory or obscene material, or any malicious code. You must not misrepresent your identity. We may, but need not, remove Feedback we consider objectionable.

12. Errors, inaccuracies and omissions

Occasionally there may be typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times or availability. We reserve the right to correct these and to change or update information, or cancel orders, where information is inaccurate.

Where a product is listed at an incorrect price because of a genuine error, we will contact you before dispatch. You may proceed at the correct price or cancel for a full refund.

13. Prohibited uses

You may use the Services for lawful purposes only. You must not use the Services for any unlawful or malicious purpose; to violate any law or regulation; to infringe intellectual property rights; to harass, abuse, defame or harm any person; to transmit false or misleading information; to send unsolicited advertising or spam; to impersonate any person or entity; or to restrict or inhibit anyone else’s use of the Services.

You must not upload viruses or malicious code; reproduce, duplicate, resell or exploit any portion of the Services; collect or track the personal information of others; spam, phish, spider, crawl or scrape; or interfere with or circumvent security features.

We may suspend, disable or terminate your account if we determine you have breached these Terms.

14. Termination

We may terminate this agreement or your access to the Services at any time, and you remain liable for amounts due up to the date of termination.

Clauses that by their nature should survive termination will do so, including Australian Consumer Law, Intellectual Property, Feedback, Termination, Liability, Indemnification, Severability, Governing Law and Privacy.

15. Disclaimer and liability

This clause is subject to clause 1 and does not limit any consumer guarantee, right or remedy that cannot lawfully be excluded.

Information presented on the Services is provided for general information purposes. To the extent permitted by law, we do not warrant its accuracy, completeness or usefulness, and we do not guarantee that your use of the Services will be uninterrupted, timely, secure or error-free.

To the fullest extent permitted by law, and subject to clause 1, we are not liable for any indirect, incidental, punitive, special or consequential loss, including lost profits, lost revenue, lost savings, loss of data or replacement costs, arising from your use of the Services or any product purchased through them.

16. Indemnification

You agree to indemnify and hold harmless Skill Launch Labs Pty Ltd, Shopify, and our respective affiliates, officers, directors, employees, agents and licensors from any losses, damages, liabilities or claims, including reasonable legal costs, payable to any third party arising out of your breach of these Terms, your violation of any law or third-party right, or your use of the Services.

17. Severability

If any provision of these Terms is found to be unlawful, void or unenforceable, it will be enforceable to the fullest extent permitted by law, and the unenforceable portion will be severed without affecting the validity of the remaining provisions.

18. Waiver and entire agreement

Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of it.

These Terms and any policies posted on this site constitute the entire agreement between you and us and supersede any prior agreements or communications.

19. Assignment

You may not assign or transfer these Terms or any of your rights or obligations without our prior written consent. We may assign or transfer these Terms without notice to you.

20. Governing law

These Terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland and the courts of appeal from them.

21. Changes to these Terms

You can review the current version of these Terms on this page at any time. We may update them by posting changes to this website. Material changes will be notified in accordance with applicable law. Your continued use of the Services after changes are posted constitutes acceptance of them.
